Lawsuit Aims To Protect Promotion and Sale of Legal Tobacco Products

Trade associations and seven tobacco manufacturers team to fight tobacco ordinances.

(csdecisions.com) – On Tuesday, Feb. 14, the National Association of Tobacco Outlets Inc. (NATO), the Cigar Association of America Inc. (CAA), along with Lorillard Tobacco Co., R.J. Reynolds Tobacco Co., American Snuff Company, Philip Morris USA Inc., U.S. Smokeless Tobacco Manufacturing Co. LLC, U.S. Smokeless Tobacco Brands Inc. and John Middleton Co., filed a federal lawsuit in the U.S. Federal District Court in Rhode Island, seeking a temporary restraining order and preliminary and permanent injunctions against the enforcement of two tobacco-related ordinances adopted on Jan. 5, 2012 by the Providence, Rhode Island City Council.

One of the ordinances bans adult consumers from redeeming tobacco product coupons and also prohibits retailers from offering certain promotionally priced tobacco products, such as “buy-one, get-one free” offers.  The second ordinance bans the sale of virtually all flavored cigars, smokeless tobacco and pipe tobacco products in the city.  Both of these ordinances are scheduled to take effect on March 1, 2012.

“The ordinances raise serious federal and state constitutional questions while also being pre-empted by federal and state laws,” said NATO President Andrew Kerstein.

Regarding these two ordinances, the lawsuit seeks a judgment declaring, among other things, that (1) the ban on coupons and promotionally priced tobacco products as well as the prohibition on the sale of flavored tobacco products, are an unconstitutional violation of both the U.S. Constitution and the Rhode Island Constitution, (2) the ordinances are pre-empted by federal laws regulating tobacco products, and (3) the ordinances are void because the city failed to give the mandatory 48-hour public notice of the meeting at which the ordinances were adopted.

The lawsuit asserts that the anti-promotion ordinance is unconstitutional because it limits the ability of retailers and manufacturers to communicate tobacco product prices to adult consumers and is pre-empted by federal law because the ordinance attempts to regulate the advertising and promotion of cigarettes.  Also, the ordinance violates the Rhode Island Constitution because it improperly attempts to regulate tobacco retailers, an authority which is reserved exclusively to the state.  In addition, the city was required to give at least 48-hours public notice of the upcoming adoption of the ordinance, but the city provided only 29-hours prior public notice.  This failure to give the proper public notice invalidates the ordinance.

The second ordinance, relating to flavored tobacco products, is unconstitutional because it severely limits how retailers and manufacturers may describe the taste or aroma of their tobacco products to consumers.  The right of Free Speech extends to commercial speech that encompasses product descriptions in advertising.  This ordinance is also pre-empted by federal law.  In addition, as with the first ordinance, this ordinance violates the Rhode Island Constitution by adopting licensing requirements that are the exclusive province of the state.  Just like the first ordinance, the City of Rhode Island failed to provide the minimum 48-hours prior public notice; for this reason also, the second ordinance is invalid.

Cameroon Tobacco and Handicraft Fair 2012

Cameroon is growing some of the best leafs for cigars - www.africacigars.com

(allafrica.com) – Scores of people streaming into the exhibition village of the ongoing third edition of the International Handicrafts Exhibition of Cameroon (SIARC) are finding soft spots in the stands occupied by the 20 flagbearers of the East Region.

The originality of the products on display and the welcoming touch with which exhibitors take visitors in and out of their stands make the stands, ‘must-visit’ places.

From the typical forest honey, agro-food products, tobacco to fine wood products, the stands hosting exhibitors offer visitors a good run for their money and time.

According to one of the exhibitors, John Gabela who is showcasing his ingenuity in tobacco farming and processing, “SIARC has helped me to realise one of my life’s dreams.”

The processed and parcelled tobacco he brought had been sold barely half way into the exhibition. “I have gained an American market. A black American came and bought everything. He took 25 kg of raw tobacco.” John Gabela said.

To Nango Fouman with her diverse processed cocoa products (chocolate in various forms); SIARC is a real place to create contacts, widen her market scope and gain experience from others in her business line.

Bienvenu Nams Ongolo, dealer in processed fruit juice from guava, tomato and other fruits, corroborated Mrs Fouman but said had craftsmen received financial assistance to better their products prior to the exhibition; the show would have been more interesting.

Trade shows can pay off in customers, exec says

Bahama Mamas CEO encourages attendance

(LVB) – Las Vegas business owners, if you haven’t attended a trade show or convention in the past year, you might want to consider doing so.

Trade shows and conventions come in and out of this city like a revolving door. So, chances are, there’s at least one related to your industry coming soon.

“If you’re a business owner, and the convention works for you, it’s one of the best ways to advance your business,” says Joe Gold, CEO of Bahama Mamas, a manufacturer of cigars.

Gold says exhibiting at trade shows has been huge for him and his company, allowing him to lure potential buyers that he otherwise wouldn’t be able to reach.

For 14 years, Gold has been exhibiting his cigar products at conventions around the globe. When he was starting out, he exhibited at a show in Macau.

“I did kind of crazy things,” Gold says, laughing.

On Feb. 1 and 2, Bahama Mamas will have a booth at the 2012 Tobacco Plus Expo International. The trade show is targeted to buyers and manufacturers within the tobacco industry.

“The exposure is immense,” Gold says.

For shows that he attends in Las Vegas, Gold tends to spend between $6,000 and $7,000 on his exhibits, which include bright orange and yellow displays of his cigar products as well as a slew of Bahama Mama girls, the models who promote the brand. Out-of-state shows cost more — between $10,000 and $13,000 — because of the travel involved.

Gold chooses different booth sizes, depending on the convention. Sometimes he opts for a 10 feet-by-10 feet; other times he’ll choose a 10 feet-by-20 feet. Occasionally, he’ll book a 20 feet-by-20 feet. When he does, a show will cost him between $15,000 and $18,000.

For out-of-state trade shows, Gold pays for hotel and airfare not only for himself, but his team of Bahama Mama girls, his executive vice president and his sales staff. But, Gold said the cost is worth it.

“For us, it has been unbelievably successful,” he stated. “It has always paid off for us.”

Gold suggests business owners research industry-specific shows, then talk to others in their line of work to see what they think of a particular convention before they go as exhibitors or attendees.

If you’re planning to go as an attendee, Gold also advises checking out the educational seminars, not only the show floor.

“It’s a mass of information and good things you can do for your business,” Gold said. “There’s lots to be gained.”
